Unless otherwise stated, an estimate is valid for acceptance for a period not exceeding 30 days from the date of the estimate. Tullulah Pig reserves the right to adjust the estimate price following inspection of the work order, job specifications and the final requirements. Changes/additions to the original job spec can, of course, increase production time, and are therefore subject to additional charges above the original quote. This will be agreed in writing at the time.
After the placing of an order and before the commencement of the order Tullulah Pig shall provide a work schedule of the hours allocated to each order. Any orders placed and subsequently cancelled or delayed without at least 48 hours before the first date in the work schedule will be charged at 50% Tullulah Pig's day rate for each day affected.
An order or the acceptance of an estimate must be accompanied by sufficient information to proceed with the order. Where specific elements of job are not described clearly and accurately by the client, the implementation of those elements will be at the discretion of Tullulah Pig. Any subsequent modifications to the specification must be confirmed in writing via email or post. Any quote includes two minor modifications to the job specifications, any modifications after that will be chargeable at a rate agreed upon at the time. Any goods rejected, or not complying for whatever reason with the order within the finished product, must be notified to Tullulah Pig in writing within 30 days of receipt in order for an inspection and remediation to be considered.
By placing an order the client declares their right to reproduce all media supplied. The client assumes absolute liability for any violation of copyright in any action brought by a third party and agrees to indemnify Tullulah Pig against any resulting loss or damage. Tullulah Pig reserves the right to refuse to work with material that it deems to be immoral or offensive, which includes but is not limited to, racist, sexist or profane content.
Unless specifically agreed, commissioned work remains the property of Tullulah Pig, and the transaction made with Tullulah Pig is deemed to be the purchase of an exclusive and indefinite license to publish the commissioned work and not for duplication or re-sale without prior permission of Tullulah Pig Ltd.
Tullulah Pig will use its best endeavours to ensure that orders are completed within any deadlines agreed at time of order but will not accept any liability for damages in the event of failure to do so. Should delay be experienced in the completion of a job the buyer does not have the right to cancel the order either entirely or in part. Tullulah Pig cannot accept responsibility for consequential loss or damage caused by errors or delay in delivery or from any cause.
The client shall be responsible for any damage caused by use or misuse of the goods. Tullulah Pig cannot accept any liability for damage or personal loss or injury of any kind however caused by purchased or licensed goods or services. The goods are supplied “as is” and without warranties as to performance or merchantability or any other warranties whether expressed or implied, save that Tullulah Pig warrants that it has the right to enter into this agreement and grant the client a licence to use the commissioned work as contemplated by the licence.
A non-refundable deposit may be required to secure hired items. Setup and installation is not included in our standard prop hire costs and will be quoted separately. Hire charges are payable even if items are returned as unused. All damages or losses will be charged for, therefore please take adequate care to ensure that all loaned items are returned in the condition in which they arrived.
All prop hire items are supplied used and therefore likely to show signs of wear and tear. We reserve the right to replace items with a suitable substitute in the event of unavailability.
We strongly recommend you insure the items you hire for the requisite value and that all steps are taken to ensure compliance with safety and fire regulations. You assume all liability and responsibility once items have been delivered until the items are returned to us.
Preferred payment method is by BACS payable to the Tullulah Pig bank account. If payment is not made on the due date, Tullulah Pig shall, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, charge interest on late payments of at 8% above the Bank of England Base rate until the outstanding amount is paid in full. If goods are being sold outright, Tullulah Pig retains title to the goods until all amounts due from the client are paid. Alternative payment arrangements must be agreed in writing.
Unless specifically agreed otherwsie, Tullulah Pig reserve the right to include reasonable additional text and/or graphics, agreed beforehand by the client, in products produced by them, for the purposes of acknowledging authorship of content.
